Customer Agreement — Design, Model Files & Optional Printing Revision: 2026-09-27-sole-proprietor-1 Status: active Operator: Jonathan Stone, trading as 3DprintmyWHAT Effective: 2026-09-27 1. Parties, scope and acceptance This agreement is with Jonathan Stone, an individual operating 3DprintmyWHAT as a sole proprietor, with a business contact address at 181 Heatherstone Lane, Rochester, NY 14618 and email 3dprintmywhat@gmail.com. The assumed-name filing has been completed. This agreement is effective September 27, 2026. References below to the Operator, we, us and our mean Jonathan Stone acting in that business capacity, not a separate LLC or a promise of limited liability. This agreement covers the website, AI-assisted design, reference uploads, model files, credits and printing expressly offered by the Operator. You must be at least 18 and legally able to contract. If acting for an organization, you must have authority to bind it. Acceptance requires an unchecked-by-default agreement box and an identified confirmation or transaction action. Browsing alone does not constitute acceptance. If you do not agree, do not use a service requiring acceptance. 2. Service scope and AI limitations The service helps develop and evaluate designs from instructions or reference images. Licensed demonstration models are not examples of AI output. An organic mesh is not necessarily editable parametric CAD. Available formats, generation charges and material options will be stated before a paid request. Outputs may contain incorrect dimensions, missing surfaces, hidden defects, unsuitable geometry or similarities to existing designs. Pictures cannot establish unseen geometry or precise measurements. This is not professional engineering, architectural, medical, legal or certification advice. A preview, automated score, repair report, quote, payment or supplier acceptance does not certify safety, compliance, strength or suitability. 3. Inputs, intellectual property and permissions You represent that you own, have permission for, or otherwise have a lawful basis for each requested use of prompts, photographs, scans, files, names, designs, logos and likenesses. Your authority must cover the relevant processing, adaptation, reproduction, manufacturing, distribution and intended commercial use—not merely viewing or downloading a reference. Honor applicable copyright, patent, trademark, trade-secret, privacy, publicity and license rights, including attribution and redistribution conditions. Review outputs and obtain any required clearance before manufacturing, advertising, selling, distributing or using them. Counterfeit or infringing requests are prohibited. Describing an output as a likeness, interpretation, fan work, AI-generated design or non-exact copy does not establish permission or immunity. We do not guarantee patent clearance, non-infringement, originality, exclusivity or eligibility for intellectual-property protection. These terms neither bind other rights holders nor extinguish their claims. 4. Processing permission and output rights You retain your existing rights in inputs. You give the Operator and necessary service providers nonexclusive permission to store, reproduce, transmit, process and adapt inputs and resulting files solely to provide requested services, conduct safety and quality checks, provide support, prevent abuse and meet lawful retention duties. An authorized print includes producing the agreed quantity and necessary fulfillment processing. This is not permission to use a private design in advertising or for model training without separate authorization. Subject to third-party rights and applicable licenses, you may lawfully use supplied output files. We do not claim your pre-existing rights or transfer rights owned by others. Downloading a model does not license copying our website, software or branding. Openly licensed examples remain governed by their stated licenses; these terms do not take away permissions those licenses grant. 5. Prohibited designs and conduct Do not use the service to create, obtain, manufacture or facilitate weapons, functional weapon components, ammunition, explosive or incendiary devices, or equipment intended to injure, threaten or facilitate violence. Criminal activity, sabotage, theft, unauthorized entry or access, unlawful surveillance, harassment, evasion of safety controls and malicious conduct are prohibited. A generally useful object or tool is prohibited when the requested design or intended use facilitates such conduct. Do not conceal a request’s purpose or divide it into parts to evade restrictions. Counterfeits, infringement, unauthorized uses of another person’s identity, illegal content and violations of applicable trade restrictions are prohibited. These service restrictions can be stricter than local possession laws. Accepting these terms does not authorize prohibited activity. Checks are not exhaustive; missed detection or successful generation does not approve a design or use. 6. No safety-critical or regulated applications Do not rely on this service for medical devices or treatment, implants, protective equipment, life-support systems, structural or load-bearing safety components, vehicle or aircraft safety systems, pressure vessels, mains electrical protection, food-contact products or products intended for children. Do not request a design whose failure could foreseeably cause serious injury, death or significant property damage. Decorative resemblance to a functional product is not evidence of suitability. The service is intended for permitted concept development, decorative objects and non-safety-critical prototypes. Regulated or professional applications would require a separately approved service, qualified professionals and applicable compliance measures; they are not authorized here. 7. Model review, finishing and use Before relying on a file, examine its dimensions, units, scale, surfaces, clearances, assemblies and intended use, and obtain competent independent review where needed. Before using or distributing an item, inspect it and undertake appropriate nonhazardous validation. Do not assume wall thickness, strength, heat resistance, fatigue, toxicity or fit has been assessed unless documented for that order. Preserve necessary warnings in permitted downstream distribution. Preparation may modify a model, including closing gaps or changing orientation. Review the prepared file and disclosed changes, not just an original or promotional image. Approval must relate to the particular file revision and print settings; changes may require renewed review. You are responsible for your instructions, unauthorized modifications and prohibited misuse, without waiving nonwaivable claims or taking over the Operator’s legal duties. 8. Third-party printing and order approval Independent providers may print and deliver items. Before payment, the order summary will identify the service, applicable provider, selected specifications, total price and any provider terms requiring acceptance. Provider terms are not incorporated through an unexplained reference and cannot remove rights the law preserves against the Operator. Screen colors are approximate. Tolerances, surface finish, support marks and durability depend on geometry, process and material. Promised specifications must appear in the order summary. A quote is not an order; model acceptance for quoting is not authorization to manufacture. Manufacturing requires separate approval of the final file, dimensions, material, color, quantity, delivery information and price. Material substitutions or material changes to an approved order require agreement. 9. Credits, charges, refunds and delivery Generation credits and physical printing are separate purchases. Charges, credit deductions, taxes, shipping and mandatory fees must be disclosed before authorization. An estimate with unconfirmed taxes or shipping is not a final payable total. Prices may change before acceptance; additional charges require authorization. Credits are service entitlements, not a bank account or investment. We will explain when credits are consumed and how technical failures are handled before a paid request. Contact us if services or goods are not supplied as agreed. Mandatory refund, repair, replacement and cancellation rights remain available. No blanket no-refunds policy or waiver of lawful payment-dispute rights applies. Disputes may temporarily restrict associated disputed credits; refunds may reverse corresponding credits without removing unrelated purchased entitlements. Delivery dates are estimates unless guaranteed. Delays will be handled with legally required notices, choices and refunds. Custom production may limit voluntary cancellation after manufacturing begins, but does not remove statutory remedies for defective, incorrect or undelivered goods. A provider’s refusal does not itself authorize charging for unfulfilled services. 10. Problems and safety incidents Contact support with your project or order identifier and a description of the issue. Stop using an apparently unsafe item, and retain the item and relevant information when safe. Cooperate reasonably with investigations, corrections or recalls. Prompt reporting helps investigation but does not shorten statutory claim periods. Do not email sensitive payment credentials or identity documents. We may coordinate investigation and appropriate remedies with manufacturers and carriers. Using independent providers does not disclaim nonwaivable seller, distributor, manufacturer, reporting or recall duties. 11. Important warranty limitations TO THE EXTENT PERMITTED BY LAW, THE DIGITAL DESIGN SERVICE AND MODEL FILES ARE PROVIDED AS IS AND AS AVAILABLE, WITHOUT IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED SERVICE, ERROR-FREE OUTPUT, ENGINEERING ACCURACY OR SUITABILITY FOR A PRINTING PROCESS. EXPRESS ORDER COMMITMENTS REMAIN SUBJECT TO THEIR STATED TERMS. This does not eliminate non-excludable warranties for physical consumer goods, override an applicable written warranty or deny remedies for failure to supply what was promised. Permitted product-specific warranty limitations must be conspicuously disclosed before purchase and assessed under applicable law. Mandatory rights remain available wherever exclusions are restricted. 12. Important limits on recoverable losses SUBJECT TO SECTION 13 AND ONLY AS LAWFULLY PERMITTED, THE OPERATOR AND THE OPERATOR'S EMPLOYEES AND AGENTS ACTING IN THEIR SERVICE ROLES WILL NOT BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL ECONOMIC LOSSES FROM DIGITAL DESIGN SERVICES OR MODEL FILES, INCLUDING LOST PROFITS, BUSINESS OPPORTUNITIES OR DATA. THIS ECONOMIC-LOSS LIMIT INCLUDES ORDINARY-NEGLIGENCE CLAIMS ONLY WHERE SUCH A LIMIT IS LAWFUL AND ENFORCEABLE. SUBJECT TO SECTION 13, THE AGGREGATE LIMIT FOR DIRECT ECONOMIC-LOSS CLAIMS ARISING SOLELY FROM DIGITAL SERVICES IS THE GREATER OF US $100 OR YOUR PAYMENTS TO THE OPERATOR FOR DIGITAL SERVICES IN THE 12 MONTHS BEFORE THE EVENT. This cap does not limit physical-product claims, mandatory refunds, protected personal-injury claims or other non-excludable liability. It is not a promise that anyone is immune from suit. 13. Rights and liabilities not excluded Nothing excludes or limits liability for fraud, willful or reckless misconduct, gross negligence or liability that applicable law prohibits excluding or limiting. Nonwaivable rights concerning death, injury, defective products, consumer protection, statutory warranties, privacy and mandatory remedies remain intact. No limitation applies where unconscionable, contrary to public policy or destructive of a mandatory remedy’s essential purpose. These terms do not bind nonparties, excuse criminal conduct, authorize infringement or create a corporate liability shield where none otherwise exists. Where a limitation is invalid, applicable law controls. Any permitted risk allocation operates only within those boundaries. 14. Third-party claims caused by your violations To the extent permitted by law, you will indemnify the Operator and personnel identified in section 12 for reasonable, documented third-party awards, authorized settlements and reasonable defense costs to the extent caused by your unlawful or unauthorized inputs, material breach of rights representations, prohibited use or unlawful downstream distribution. This does not cover losses to the extent caused by the protected party’s own negligence, wrongful conduct, contractual breach or nonwaivable legal duties. We must notify you reasonably promptly and provide reasonable cooperation. No settlement may impose an admission, payment or nonmonetary obligation on you without written consent. Defense arrangements and settlements must be reasonable. This is not permission to transfer every business risk or all legal bills to a customer; mandatory consumer protections prevail. 15. Refusal, suspension and rights reports We may decline, pause, remove or restrict requests as reasonably necessary for safety, suspected infringement, fraud, legal compliance or material violations. We may request clarification or evidence of permission and preserve relevant records subject to law and the Privacy Notice. Suspension does not forfeit prepaid amounts or statutory remedies without lawful grounds. Rights holders and safety reporters may contact support with the relevant model or page, contact details, the asserted right or risk and supporting information. We may investigate and restrict access during review. A statutory copyright-agent procedure will be published separately if established; this agreement claims neither appointed-agent nor safe-harbor status. 16. Privacy and agreement records The Privacy Notice describes account, design, reference, transaction and delivery processing. Agreement acceptance is not marketing consent. Private designs will not be used in advertising without separate permission. Supply accurate information, protect your account and keep important files; the stated storage period is not permanent archival storage. Acceptance records include the agreement revision and exact text or verifiable snapshot, account identifier, server receipt time, acceptance action and relevant project, file or order references. This supports transaction and dispute records, not a guarantee of enforceability. Records may be retained for contractual, fraud, tax, safety and legal purposes, subject to applicable rights and retention limits. 17. Applicable law and disputes The governing law is New York law without depriving consumers of mandatory protections under otherwise applicable law. Courts must have lawful jurisdiction; this agreement imposes no exclusive distant forum. Contacting support is encouraged but does not suspend or shorten filing deadlines or statutory rights. This agreement imposes no mandatory arbitration, class-action waiver or jury-trial waiver. Any later proposal requires legal review and conspicuous prospective disclosure. 18. Revisions, severability and contact Material changes will require new affirmative acceptance before governing future covered transactions. A later website revision does not automatically govern an earlier order or accrued dispute. The accepted revision and applicable order specifications govern that transaction. An unenforceable provision is severed or limited only as law permits without defeating mandatory rights; the remainder continues where lawful. Non-enforcement on one occasion is not a general waiver. The agreement and clearly disclosed, accepted order terms govern the service without displacing mandatory law or separate express commitments. The Operator's legal name and business contact details are stated in section 1. Questions: 3DprintmyWHAT@gmail.com.
